Policing powers 'should be devolved'

Powers over policing should be given to the Welsh government, a landmark report is expected to say.

This is the second report of the Silk Commission which endorses calls for more powers to be devolved to Cardiff.

It also says more assembly members are needed, although it is not expected to specify how many.

The commission has been examining calls to give the Welsh government more powers, including over energy policy and youth justice.

Some tax and borrowing powers are already being devolved as a result of a previous inquiry by the commission.

Set up by the Westminster coalition, the commission will publish its second and final report on Monday.

Red tape

The report is likely to be welcomed by First Minister Carwyn Jones and his Labour administration which has sought the powers over policing.

There are mixed views over the issue among the four police and crime commissioners (PCCs) in Wales.

North Wales PCC Winston Roddick says policing should be devolved unless there are good operational reasons against it.

But Dyfed-Powys PCC Christopher Salmon believes it will do nothing to cut crime while adding to costs and red tape.

South Wales PCC Alun Michael has also said policing should be devolved, while Gwent PCC Ian Johnston says the matter should only be considered as part of the whole criminal justice system.

The first minister has also sought a Scottish-style model of devolution - known as a "reserved powers" system - to set out what is and what is not devolved to Wales.

Advocates say it is more clear cut and would prevent legal tussles over legislation passed by the assembly.

The UK government has mounted supreme court challenges against two bills passed in Cardiff Bay since the assembly acquired more law-making powers at a referendum in 2011.

The Silk Commission found there was no case to return any powers to the UK government, BBC Wales understands.

Led by the assembly's former clerk Paul Silk, it also says more AMs are needed, but does not say how many.

The assembly's presiding officer has called the number of members to rise from 60 to 80 to cope with the institution's growing workload.

Tax referendum

Speaking to the BBC's Sunday Politics Wales, Welsh Liberal Democrat leader Kirsty Williams said more powers for the assembly could result in fewer Welsh MPs at Westminster.

"I think it's inevitable that if we move extra powers to the assembly, we have to question whether we reduce the number of Welsh MPs we send to Westminster and look to potentially increase the number of assembly members," she said.

The commission's first report said the Welsh government should get powers over some taxes, including stamp duty, and have limited powers to borrow money.

Partial control over income tax would follow a referendum.

The UK government has started the process of enacting the tax and borrowing powers in Westminster with its Draft Wales Bill.
